Section 317 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023

📜 Section 317: Interpreter to be Bound to Interpret Truthfully

Text of the Section:

When the services of an interpreter are required by any Criminal Court for the interpretation of any evidence or statement, he shall be bound to state the true interpretation of such evidence or statement.

🧭 Purpose and Context

Section 317 of the BNSS, 2023, emphasizes the critical role of interpreters in ensuring accurate and truthful communication during criminal proceedings. It mandates that interpreters must provide a true and faithful interpretation of any evidence or statement presented in a language other than that of the court. This provision is essential for maintaining the integrity of the judicial process, ensuring that all parties, including the accused, witnesses, and legal representatives, have a clear and accurate understanding of the proceedings.

⚖️ Comparison with the Code of Criminal Procedure (CrPC)

Section 317 of the BNSS, 2023, mirrors Section 282 of the Code of Criminal Procedure (CrPC), 1973. Both sections impose a legal obligation on interpreters to provide truthful and accurate translations of evidence and statements in criminal cases.

🧭 Significance

Ensures Fairness: By requiring interpreters to provide accurate translations, this section helps prevent misunderstandings that could lead to unjust outcomes.

Upholds Judicial Integrity: Accurate interpretation ensures that the court's decisions are based on a true understanding of the evidence and statements presented.

Protects Rights: This provision safeguards the rights of non-native speakers or those with language barriers, ensuring they receive a fair trial.
