CrPC Section 207

Section 207 of the Code of Criminal Procedure (CrPC), India

Section 207: Supply to the accused of copy of police report and other documents

Text:

"When a complaint has been made or a police report is received, the Magistrate shall, if he takes cognizance of the offence, supply to the accused free of cost a copy of—
(a) the police report;
(b) the first information report;
(c) the statements of the witnesses recorded under section 161 or section 164;
(d) any other relevant document or relevant extract from the case diary."**

Explanation:

Once the Magistrate takes cognizance of a case (i.e., formally starts the trial), the accused has a right to get copies of important documents free of cost.

This includes the police report, FIR, witness statements, and other documents that the prosecution will rely on.

The purpose is to enable the accused to prepare a proper defense by knowing the case against them.

Purpose:

To ensure fair trial and natural justice.

Prevent surprise or ambush by the prosecution.

Promote transparency and help the accused effectively defend themselves.

Example:

If a person is charged with theft, the court must give them copies of the FIR and statements of witnesses so they can examine these and prepare their case.
