Section 323 – Return of Commission
Execution and Return: When a commission issued under Section 319 has been duly executed, it, along with the deposition of the witness, shall be returned to the court or Magistrate who issued the commission.
Inspection by Parties: The commission, its return, and the deposition of the witness shall be open to the inspection of the parties and shall form part of the record of the case.
Admissibility as Evidence: If the deposition of the witness satisfies the conditions laid down in Section 27 of the Bharatiya Sakshya Adhiniyam, 2023, it may be used as evidence in any other judicial proceeding.
