Section 108 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 empowers a Magistrate to direct a search to be conducted in their presence at any location where they are authorized to issue a search warrant. This provision is analogous to Section 103 of the Indian Penal Code (IPC), which similarly allows a Magistrate to direct a search in their presence at any place for which they are competent to issue a search warrant.
