IPC Section 167
🔹 IPC Section 167: Procedure when investigation cannot be completed in 24 hours
What Section 167 Actually Is:
Important:
Section 167 is NOT part of the Indian Penal Code (IPC). It belongs to the Code of Criminal Procedure (CrPC), Section 167.
Why this is important:
IPC deals with offenses and punishments.
CrPC deals with the procedure to investigate and try those offenses.
🔍 What does CrPC Section 167 say?
When a person is arrested and police cannot complete the investigation within 24 hours,
The police must produce the arrested person before a magistrate.
If the investigation is still incomplete, the magistrate can authorize the detention of the accused in custody (police or judicial) for a further period (usually up to 15 or 90 days depending on the crime).
If the investigation cannot be completed within that extended time, the accused must be released on bail.
Why is this important?
It protects the rights of arrested persons from indefinite detention without trial.
It balances police investigation needs and individual liberty.
Summary:
IPC → defines crimes and punishments.
CrPC Section 167 → procedure about detention during investigation.
