IPC Section 387 – Putting a Person in Fear of Death or Grievous Hurt to Commit Extortion

Purpose

This section is designed to punish extortion by threatening someone with death or serious bodily harm. It combines threats and coercion to unlawfully obtain property.

Provision

Whoever threatens a person with death or grievous hurt (serious injury),

With the intent to commit extortion (i.e., unlawfully obtain property),

Commits an offence under this section.

Punishment:

Imprisonment up to 3 years, or

Fine, or

Both.

Threat must involve death or grievous hurt.

The intent to extort property is essential.

This is a cognizable offence → police can register a case without court permission.

It is less severe than Sections 388 or 390 IPC, which deal with robbery.

Example

A person threatens his neighbor:

“If you don’t give me ₹50,000, I will stab you.”

The threat is meant to force the neighbor to hand over money.

This falls under Section 387 IPC.

Another example: Threatening a shopkeeper to hand over cash, otherwise harm will be caused.
