Section 457 of the Criminal Procedure Code (CrPC), 1973:

Section 457 – Search of places entered by a person sought to be arrested

This section deals with the procedure for searching places that a person sought to be arrested is likely to have entered.

Key points of Section 457:

When a person is wanted to be arrested by the police, but cannot be found,

The police may apply to the Magistrate to authorize a search of any place where they believe the person may be hiding or have entered.

The Magistrate may issue a search warrant authorizing the police to enter and search such places.

The purpose is to locate and arrest the person who is evading arrest.

Why is Section 457 important?

It gives the police legal authority to enter and search premises in the course of arresting a suspect.

Protects the rights of property owners by involving Magistrate’s oversight.

Helps in efficiently apprehending accused persons who are absconding.
