Section 343 CrPC – Mode of sending case to Court of Session
Text:
"Where a Magistrate commits a case for trial to a Court of Session, he shall forward to that Court—
(a) the case diary (if any) made in the case,
(b) the statements recorded under Section 161 of the Police Act,
(c) the documents submitted with the complaint,
(d) a copy of the order of commitment, and
(e) a copy of any warrant or summons issued in the case."
Meaning / Explanation:
When a Magistrate commits a case to the Court of Session for trial (usually under Section 209 CrPC or 323 CrPC), the Magistrate must send all relevant documents and records to the Sessions Court.
This includes:
The case diary (investigation details by police),
Statements recorded by police under Section 161 CrPC,
All documents submitted with the complaint,
The order of commitment (Magistrate’s order sending the case),
