IPC Section 125

🔹 IPC Section 125 – Order for Maintenance of Wives, Children, and Parents

Note: Actually, Section 125 of the Code of Criminal Procedure (CrPC)—not IPC—deals with maintenance of wives, children, and parents. IPC doesn’t have Section 125 related to maintenance. It’s a common confusion.

So, just to clarify:

Section 125 of the CrPC provides the legal provision for maintenance to wives, children, and parents who are unable to maintain themselves.

The Indian Penal Code (IPC) does not contain Section 125 about maintenance.

Brief about Section 125 of the CrPC (since many people confuse):

If a person having sufficient means neglects or refuses to maintain:

His wife (who cannot maintain herself),

His legitimate or illegitimate minor children,

His legitimate adult children (unable to maintain themselves due to physical or mental abnormality),

His parents (unable to maintain themselves),

The object is to prevent vagrancy and destitution and to provide social justice.

⚖️ Importance:

Provides quick and easy relief to dependent family members without going through long civil suits.

Non-payment of maintenance is a criminal offense punishable under Section 125 CrPC.

Summary:

IPC Section 125 does not exist for maintenance.

Maintenance law is governed by Section 125 of the CrPC.
