Lurking house-trespass or house-breaking by night
Whoever commits lurking house-trespass or house-breaking by night shall be punished with imprisonment of either description for a term which may extend to five years, and shall also be liable to fine.

Explanation:

This section applies when a person trespasses or breaks into a house at night.

“Night” typically means the period between sunset and sunrise.

The offense is considered more serious because it involves unlawful entry into a dwelling during nighttime, which is presumed to be more dangerous or threatening.

Punishment can be imprisonment up to 5 years and a fine.
