Punishments Under Section 4 of the BNS, 2023
According to Section 4, offenders may be liable for the following punishments:
Death – The most severe punishment, applicable in the rarest of rare cases, such as heinous crimes like terrorism and brutal murders
Imprisonment for Life – A convict sentenced to life imprisonment is generally expected to spend their entire natural life in prison unless commuted or pardoned.
Imprisonment – This includes two descriptions:
Rigorous Imprisonment – Includes hard labor, such as working in prison factories.
Simple Imprisonment – No hard labor is required, typically for minor offenses like civil disobedience.
Forfeiture of Property – The court may order the seizure of property belonging to the offender, often used in cases of financial fraud or smuggling.
Fine – A monetary penalty imposed either as the primary punishment or in addition to imprisonment.
Community Service – A newly introduced punishment where the offender performs unpaid work for the benefit of society instead of facing imprisonment. This focuses on reformation and rehabilitation of the offender while benefiting the community
These provisions are designed to provide a comprehensive framework for dealing with various offenses, balancing deterrence with opportunities for reform.
