What is Free Legal Aid?
Free Legal Aid means providing legal services to those who cannot afford to hire a lawyer, ensuring that justice is accessible to all, regardless of economic or social status.
Legal Basis in India
Constitution of India:
Article 39A of the Directive Principles of State Policy:
Directs the state to ensure that the legal system promotes justice on the basis of equal opportunity and to provide free legal aid to ensure that oppressed and marginalized sections are not denied access to justice.
Article 21:
The Supreme Court has interpreted the right to life and personal liberty to include the right to legal aid.
Legal Services Authorities Act, 1987:
This Act institutionalizes free legal aid across India through Legal Services Authorities at the national, state, and district levels.
Who is Eligible?
Legal aid is provided to:
Scheduled Castes and Scheduled Tribes
Women and children
Persons with disabilities
Victims of trafficking and disasters
Industrial workers
Persons with annual income below a certain threshold
