A person is deemed to have abetted the doing of a thing if they:
Instigate any person to do that thing; or
Engage with one or more other persons in any conspiracy for the doing of that thing, provided that an act or illegal omission takes place in pursuance of that conspiracy and in order to the doing of that thing; or
Intentionally aid, by any act or illegal omission, the doing of that thing.
Explanations
Explanation 1: A person who, by wilful misrepresentation or wilful concealment of a material fact which they are bound to disclose, voluntarily causes or procures, or attempts to cause or procure, a thing to be done, is said to instigate the doing of that thing
Illustration: A public officer, authorized by a court warrant to apprehend Z, is misled by another person who, knowing that C is not Z, represents C as Z, leading the officer to apprehend C. In this scenario, the person who misrepresented C as Z is considered to have abetted the apprehension of C through instigation.
Explanation 2: Whoever, either prior to or at the time of the commission of an act, does anything in order to facilitate the commission of that act, and thereby facilitates the commission thereof, is said to aid the doing of that act
Comparison with Indian Penal Code (IPC)
Section 45 of the BNS, 2023, aligns closely with Section 107 of the Indian Penal Code, 1860, which defines abetment. Both provisions encompass instigation, conspiracy, and intentional aid as forms of abetment.
