📜 Section 264: Conviction on Plea of Guilty
If the accused pleads guilty, the Magistrate shall record the plea and may, in his discretion, convict him thereon.
⚖️ Comparison with CrPC Section 241
Section 264 of the BNSS, 2023 mirrors Section 241 of the Code of Criminal Procedure (CrPC), 1973, which also allows a Magistrate to convict an accused based on a guilty plea. Both sections grant the Magistrate the discretion to convict the accused upon recording the guilty plea.
🧾 Example Scenario
Scenario: Ravi is accused of shoplifting. During the trial, he admits to the offence and pleads guilty.
Application of Section 264: The Magistrate records Ravi's guilty plea and, exercising discretion, convicts him for the offence. The Magistrate may then proceed to determine the appropriate sentence.
