1. Appeal

2. Review

A review is a request made to the same court that passed a judgment to re-examine it due to an error or new evidence.

To correct a mistake apparent on the face of the record or account for newly discovered evidence.

๐Ÿ”‘ Key Features:

Filed before the same court

Grounds for review under Order XLVII of CPC, 1908:

Mistake/error apparent on record

New and important evidence not within knowledge earlier

Any other sufficient reason

Not an appeal in disguise

A person files a review petition in the High Court after a judgment, citing a factual error or missing evidence.

3. Revision

๐Ÿ“Œ Definition:

Revision is a power exercised by a higher court (usually High Court) to correct a jurisdictional or legal error made by a lower court.

To supervise and correct jurisdictional errors or illegal exercise of power by subordinate courts.

๐Ÿ”‘ Key Features:

Discretionary power of the higher court (no automatic right like appeal)

Used when no appeal lies

High Court may act suo motu (on its own) or on application

Provided under Section 115 of CPC and Sections 397โ€“401 of CrPC
