Section 341 of the Criminal Procedure Code (CrPC), 1973 (India):

Section 341 CrPC — Punishment for Wrongful Restraint

📜 Text of Section 341:

"Whoever wrongfully restrains any person shall be punished with simple imprisonment for a term which may extend to one month, or with a fine which may extend to five hundred rupees, or with both."

🔍 Explanation and Key Points:

Meaning of “Wrongful Restraint”:

Preventing a person from moving in any direction in which he has a right to move.

It means restraining someone unlawfully, without legal justification.

Difference from Wrongful Confinement (Section 340 IPC):

Wrongful Restraint: Prevents movement in one direction only.

Wrongful Confinement: Prevents movement in all directions (confines in a particular area).

Nature of Offence:

It is a cognizable, bailable, and non-compoundable offence.

Punishment:

Simple imprisonment up to 1 month, or

Fine up to Rs. 500, or

Both.

⚖️ Illustration:

If A blocks the way of B and stops B from moving forward or in a particular direction without any lawful reason, A is said to have committed wrongful restraint.

📝 Important:

The offence concerns unlawfully obstructing movement, not causing injury.

The act must be intentional or at least knowingly wrongful.
