Section 280 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023

Section 280 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 addresses the withdrawal of a complaint in criminal cases.

🧾 Section 280: Withdrawal of Complaint

This section allows a complainant to withdraw their complaint at any time before a final order is passed in the case. The complainant must satisfy the Magistrate that there are sufficient grounds for permitting the withdrawal. If the Magistrate is satisfied, they may permit the withdrawal and shall acquit the accused against whom the complaint is withdrawn

⚖️ Legal Context

This provision is analogous to Section 257 of the Indian Penal Code (IPC), which also deals with the withdrawal of complaints in criminal cases. Both provisions ensure that a complainant has the right to withdraw a complaint before a final order is passed, provided there are sufficient grounds for such withdrawal.

🔍 Practical Implications

For the Complainant: Provides an opportunity to withdraw a complaint if circumstances change or if they no longer wish to pursue the case.

For the Accused: Ensures that if a complaint is withdrawn, they are acquitted, preventing unnecessary legal proceedings.

For the Judiciary: Allows the court to formally conclude the case when a complaint is withdrawn, ensuring judicial efficiency.
