IPC Section 216

First, a quick clarification:

Section 216 is actually part of the Code of Criminal Procedure (CrPC), not the Indian Penal Code (IPC).

🔹 CrPC Section 216: Arrest to be made by warrant in cases punishable with imprisonment for more than three years

What does Section 216 say?

When a magistrate issues a warrant for arrest in cases where the offense is punishable with imprisonment for more than three years,

The warrant must be executed by arresting the person named in the warrant,

The warrant authorizes the arrest of the accused to bring them before the court.

Why is this important?

It regulates how arrests must be made in serious cases.

Ensures proper legal authority (warrant) is used for arresting persons accused of serious offenses.

Protects people from arbitrary arrests in such cases.

Example:

If someone is accused of robbery (punishable with more than 3 years imprisonment), the magistrate issues a warrant under Section 216 to arrest that person and produce them before the court.
