Section 358 of the Bharatiya Nyaya Sanhita (BNS), 2023

Section 358 of the Bharatiya Nyaya Sanhita (BNS), 2023 deals with:

"Disobedience to order duly promulgated by public servant"

Provision:

If a person:

Knowingly disobeys an order issued by a public servant (who is lawfully empowered to do so),

And the disobedience causes or risks causing obstruction, annoyance, injury, or danger to human life, health or safety, or causes or risks causing a riot or affray,

then that person shall be punished.

Punishment:

Simple imprisonment for up to 6 months, or

Fine up to ₹1,000, or

Both

Important Notes:

The section requires that the offender knew about the order and intentionally disobeyed it.

This section is typically used in situations like violating curfew, restrictions during processions, or orders during emergencies.
