CrPC Section 415

Section 415 of the Criminal Procedure Code (CrPC), India:

Section 415 CrPC — Security for good behaviour and for keeping the peace

What does Section 415 say?

This section empowers a Magistrate to require a person to enter into a bond (security) to keep the peace and maintain good behaviour if the Magistrate reasonably believes the person:

Has threatened or is likely to cause a breach of peace, or

Has behaved in a way that disturbs public tranquility or causes annoyance.

Key Points:

Who can be bound?

Any person whom the Magistrate believes may cause a breach of peace or disturb tranquility.

How is the security taken?

The Magistrate can require the person to execute a bond with or without sureties as security.

Purpose:

To prevent disturbances and maintain public order.

If the person refuses or breaks the bond:

They can be punished or detained for breach of the bond conditions.

Difference from Section 385 CrPC:

Section 385 deals with requiring security when there is apprehension of breach of peace.

Section 415 is wider and also covers good behaviour beyond just peacekeeping.

Example:

If a person has been repeatedly involved in fights or disturbing public peace, the Magistrate may require them to enter into a bond promising to behave well and keep the peace, failing which they may face legal action.
