CrPC Section 292

Section 292 of the Criminal Procedure Code (CrPC), 1973:

Section 292 CrPC – When complaint may be withdrawn

🔹 Text of Section 292:

292. When complaint may be withdrawn.

The Magistrate may, with the consent of the complainant, withdraw from the Court any complaint made to him and recorded by him and may record a confession of the complainant to the withdrawal and shall thereupon acquit the accused.

🔎 Explanation and Key Points:

This section allows the complainant to withdraw their complaint before the court.

Withdrawal requires the Magistrate’s permission and consent of the complainant.

When the complaint is withdrawn:

The Magistrate records the confession (statement) of the complainant regarding the withdrawal.

The accused is acquitted (released from the charges).

This provision is typically applicable in cases instituted on complaint (not on police report).

Practical effect:

Gives the complainant control to withdraw a complaint if they no longer wish to pursue the matter.

Helps avoid prolonged litigation where the complainant is no longer interested.

Protects the accused by ensuring that when complaints are withdrawn, they are formally acquitted.
