IPC Section 243

IPC Section 243 deals with "Dangerous act done by a person suffering from infectious disease."

Text of Section 243 IPC:

"Dangerous act done by a person suffering from infectious disease.— Whoever, being affected with any infectious disease dangerous to life, does any act, with intent to spread the infection of such disease, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine, or with both."

Key Points:

The person must be suffering from an infectious disease dangerous to life.

The act must be done with intent to spread the infection (i.e., intentional, not negligent).

Punishment: Imprisonment up to 6 months, or fine, or both.

Difference from Section 242:

Section 242 covers negligent acts likely to spread disease.

Section 243 covers intentional acts to spread the disease.

Example:

If someone knowingly infected with a dangerous contagious disease intentionally coughs or spits on others to infect them, they can be charged under Section 243.
