IPC Section 137 — Taking possession of or detaining property

📜 Text of Section 137 IPC (Simplified)

"Whoever, being empowered by law to take possession of any property or to detain any person or thing, takes or detains such property or detains such person or thing beyond the time for which such possession or detention is authorized by law, shall be punished with imprisonment for a term which may extend to three months, or with fine which may extend to five hundred rupees, or with both."

Person empowered by law
The person who takes or detains property or person must be authorized by law to do so. Examples:

Police officer seizing evidence.

Court official taking possession of property under a legal order.

Government official detaining property in accordance with law.

Taking or detaining possession
The person must actually take possession or detain property or person.

Detaining beyond authorized time
The possession or detention must be beyond the time allowed by law. If possession or detention is within the legal time frame, no offense is committed.

Unauthorized possession/detention
Holding the property/person longer than permitted is the offense.

The vehicle should be returned or released once the legal process allows or after a court order.
