⚖️ Section 484 CrPC — Repeal and Savings

📜 Text of Section 484 CrPC:

The Code of Criminal Procedure, 1898 (Act V of 1898), is hereby repealed.
Provided that the repeal shall not affect —
(a) the previous operation of the said Act or anything duly done or suffered thereunder;
(b) any right, privilege, obligation or liability acquired, accrued or incurred under the said Act;
(c) any penalty, forfeiture or punishment incurred in respect of any offence committed against the said Act;
(d) any investigation, inquiry, trial or other proceeding under the said Act, so far as such investigation, inquiry, trial or other proceeding is not inconsistent with the provisions of this Code, and the provisions of this Code shall apply thereto.

Key Points:

This section officially repeals the earlier Code of Criminal Procedure, 1898.

It includes savings provisions to protect:

Past actions taken under the 1898 Code,

Rights and liabilities already acquired,

Penalties or punishments already incurred,

Ongoing investigations, trials, or proceedings as long as they don’t conflict with the new Code.

Ensures a smooth transition from the old Code to the 1973 Code without legal gaps.

🔍 Purpose:

To avoid legal confusion or disruption due to the repeal of the old law.

To preserve the validity of all legal proceedings and actions started under the old Code.

To allow ongoing cases to continue without being affected adversely by the new legislation.
