CrPC Section 108
⚖️ Section 108 – Security for good behaviour from persons disseminating seditious matters
Purpose:
This section empowers an Executive Magistrate to take preventive action against individuals who are likely to commit offences against the State by:
Spreading seditious material, or
Making statements or representations that could cause public unrest or threaten national security.
When It Applies:
A person may be required to provide security (bond) for good behaviour if:
They have been found:
Circulating seditious or hate-inciting content (in the form of documents, speeches, social media posts, etc.).
Making or disseminating statements that promote enmity, hatred, or disturb public tranquility.
The Magistrate has credible information or reason to believe that the person is likely to continue doing so.
Procedure:
A show cause notice is issued by the Magistrate asking why the person should not be ordered to provide security.
If the person fails to satisfy the Magistrate, they may be directed to:
Execute a bond (with or without sureties),
For a period not exceeding one year.
📌 Example:
If someone is found distributing pamphlets inciting violence against a particular community or speaking publicly against the government in a way that threatens public order, a Magistrate can act under Section 108 CrPC and demand a security bond for future good behaviour.
