Section 62 of the Bharatiya Nyaya Sanhita (BNS), 2023
Section 62 of the Bharatiya Nyaya Sanhita (BNS), 2023, addresses the punishment for attempting to commit serious offenses. It stipulates that any individual who attempts to commit an offense punishable by this Sanhita with imprisonment for life or any other term of imprisonment, or attempts to cause such an offense to be committed, and in doing so performs any act towards the commission of the offense, shall be punished accordingly.
Key Provisions of Section 62
Punishment for Attempt: If no specific provision is made by this Sanhita for the punishment of such an attempt, the individual shall be punished with imprisonment of any description provided for the offense, for a term which may extend to one-half of the imprisonment for life or, as the case may be, one-half of the longest term of imprisonment provided for that offense, or with such fine as is provided for the offense, or with both.
Illustrations:
(a) A attempts to steal jewels by breaking open a box but finds no jewels inside. Despite the failure, A has done an act towards the commission of theft and is guilty under this section
(b) A attempts to pick the pocket of Z by thrusting his hand into Z's pocket but fails because Z has nothing in his pocket. A is still guilty under this section
These provisions align with Section 511 of the Indian Penal Code (IPC), which similarly punishes attempts to commit offenses punishable with imprisonment for life or other imprisonment.
