Section 112 of the Bharatiya Nyaya Sanhita (BNS), 2023, addresses "Petty Organised Crime" and outlines both the definition of the offence and the corresponding penalties.

Section 112: Petty Organised Crime

Subsection (1): Definition of Offence

This subsection criminalizes the act of being a member of a group or gang, either individually or jointly, and committing any of the following acts:

Theft

Snatching

Cheating

Unauthorised selling of tickets

Unauthorised betting or gambling

Selling of public examination question papers

Any other similar criminal act

Explanation: For the purposes of this subsection, "theft" includes:(

Trick theft

Theft from vehicle

Dwelling house or business premises theft

Cargo theft

Pickpocketing

Theft through card skimming

Shoplifting

Theft of Automated Teller Machine (ATM)(

These provisions aim to address crimes committed by organized groups, emphasizing collective involvement in unlawful activities.

Subsection (2): Penalty

Any individual found guilty of committing petty organised crime under this section shall be punished with:

Imprisonment for a term not less than one year, which may extend to seven years

A fine

This subsection establishes the legal consequences for engaging in such criminal activities, aiming to deter organized petty crimes

It's important to note that while the BNS, 2023, introduces this definition and penalty, some legal experts have raised concerns about the ambiguity of terms like "group or gang" and "any other similar criminal act," which may lead to challenges in enforcement and interpretation. (
