🔹 Section 28 – The Prevention of Corruption Act, 1988

Section 28. Act to be in addition to any other law

"The provisions of this Act shall be in addition to, and not in derogation of, any other law for the time being in force and nothing contained herein shall exempt any public servant from any proceeding which might, apart from this Act, be instituted against him."

📘 Explanation:

"In addition to": This Act operates alongside other laws, such as the Indian Penal Code (IPC), CrPC, or service conduct rules.

"Not in derogation of": It does not override or reduce the effect of any other law.

Public servants can be prosecuted under this Act as well as other applicable laws.

⚖️ Implication:

A corrupt public servant may face action under:

Prevention of Corruption Act, and

Indian Penal Code (IPC) – e.g., criminal breach of trust, cheating, forgery, etc.

Service laws – disciplinary action under service conduct rules.

🧑‍⚖️ Example:

If a public servant commits forgery (Section 468 IPC) along with accepting a bribe (Section 7 of PC Act), they can be prosecuted under both laws, and Section 28 allows that.
