Section 240 of the Bharatiya Sakshya Adhiniyam, (BSA), 2023
There is no Section 240 in the Bharatiya Sakshya Adhiniyam, 2023 (BSA) — the Act comprises only Sections 1 through 170
However, Section 240 does exist in the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) — the new procedural code replacing the CrPC. That section is titled "Recall of Witnesses when charge altered", and it states that:
Whenever a charge is altered or added to by the Court after the commencement of the trial, the prosecutor and the defence may apply, and the Court may recall witnesses for further examination on the matter affected by the alteration. (
