Section 159 – Search for persons wrongfully confined

Summary:

When a Magistrate receives information or has reason to believe that a person has been wrongfully confined or detained, the Magistrate has the power to:

Order a search for that person in any place within their jurisdiction,

Enter and search any building or place where the person might be confined.

This power is exercised to secure the release of the person wrongfully confined.

The search and seizure must be conducted under the Magistrate’s authority and in accordance with the law.

Purpose:

To protect individual liberty by enabling Magistrates to act swiftly and locate persons who have been illegally detained or confined.
