Section 73: Compounding of Offences

Compounding of offences means that certain offences can be settled between the victim and the accused without the need for a trial or conviction, usually by mutual agreement and payment of compensation.

The provision allows for certain offences to be compounded:

If the offence is compoundable under BNS.

The offence can be compounded by the complainant or the person against whom the offence has been committed.

The court may accept the compromise if:

The offence is one which the law permits to be compounded.

The compromise is genuine and voluntary.

The public interest and justice are not adversely affected.

Once the offence is compounded, further prosecution ceases, and the accused is discharged.

The section lays down the procedure and authority for compounding and consequences of such compounding.
