Intellectual Property Laws at Nauru

Nauru has established a structured intellectual property (IP) system to protect the rights of creators and innovators. The Intellectual Property Division within the Department of Justice & Border Control oversees the administration of IP rights in the country. This division is responsible for the registration and enforcement of patents, trademarks, and copyrights. It was formally established under Section 11A of the Public Service Act 2016, with its creation published in the Gazette on May 14, 2021. 

🏛️ Key IP Laws in Nauru

Patents Registration Act 1973 & Regulations -Governs the registration of patents in Nauru -Applications are accepted for inventions granted patents by the Commonwealth of Australia, the United Kingdom, or the United States

Trademarks Act 2019 & Regulations -Provides for the registration and protection of trademarks. Registered trademarks in Nauru are protected for a period of 10 years

Copyright Act 2019 (Act No. 17 of 2019, as amended by the Revised Written Laws Act 2021) -Protects literary, artistic, and scientific works, including computer programs and traditional cultural expressions -Copyright protection lasts for the life of the author plus 50 years

🌐 International IP Engagement

In 2020, Nauru became a member of the World Intellectual Property Organization (WIPO) and joined the *Berne Convention for the Protection of Literary and Artistic Works. These memberships, effective from May 11, 2020, signify Nauru's commitment to aligning its IP laws with international standard.
