Geographical Indications (GIs) are a type of intellectual property that identify a product as originating from a specific place, where a given quality, reputation, or characteristic of the product is essentially attributable to its geographical origin.

1. Legal Framework in Algeria

Algeria recognizes and protects Geographical Indications (GIs) through its national intellectual property system. The main legal instrument governing GIs in Algeria is:

Ordinance No. 03-06 of July 19, 2003 on Patents, Utility Certificates, Trademarks, and Service Marks, Industrial Designs, and Models.

This ordinance includes provisions related to Appellations of Origin and Geographical Indications.

It was enacted to align with international standards, particularly the TRIPS Agreement (Trade-Related Aspects of Intellectual Property Rights) under the World Trade Organization.

2. Key Features of the Law

Definition: GIs in Algeria cover names or signs used on products that have a specific geographical origin and possess qualities or a reputation due to that origin.

Protection of Appellations of Origin: Algeria provides strong protection for appellations of origin, a specific type of GI with more stringent requirements concerning the link between product qualities and geographic area.

Registration System: Producers can apply for the registration of a GI or an appellation of origin with the INAPI (Institut National Algérien de la Propriété Industrielle).

Exclusivity: Once registered, only producers within the defined geographical area who meet the product specifications can use the GI.

Enforcement: Misuse of a GI or misleading use of geographic names is subject to administrative and judicial action.

3. International Treaties and Agreements

Algeria is a member of:

WTO (since 1995 as an observer; not yet a full member, but aligning its IP laws with TRIPS).

Paris Convention for the Protection of Industrial Property.

Lisbon Agreement for the Protection of Appellations of Origin (since 1972).

Some recognized GIs in Algeria include:

Deglet Nour dates (from the Ziban and Ouargla regions)

Ras El Ma olive oil
