Trade Secrets Law in Artsakh
As of May 2025, the Republic of Artsakh (Nagorno-Karabakh) has ceased to exist as a self-governing entity. On January 1, 2024, it formally dissolved following a military offensive by Azerbaijan and the subsequent displacement of over 100,000 ethnic Armenians from the region
Prior to its dissolution, Artsakh operated under its own legal framework, which included provisions for the protection of trade secrets. For instance, the Artsakh Law on the Right to Information recognized trade secrets as legitimate exceptions to the public's right to access information, provided that their disclosure would harm legitimate interests . Additionally, the Constitution of the Republic of Artsakh, adopted in 2017, affirmed the state's commitment to the rule of law and social justice .
However, with the dissolution of Artsakh, its legal system, including laws related to trade secrets, is no longer in effect. The region is now under Azerbaijani control, and any legal matters, including those pertaining to trade secrets, would fall under Azerbaijani jurisdiction.
In Azerbaijan, trade secrets are protected under the Law on Trade Secrets, which defines trade secrets as information related to the productive, technological, managerial, financial, and other activities of legal entities and individuals, the disclosure of which without the owner's consent could harm their legitimate interests .
