Intellectual Property Laws at Mali

Mali has a structured intellectual property (IP) legal framework that aligns with international standards, particularly through its membership in the African Intellectual Property Organization (OAPI). Here's an overview of Mali's IP laws, enforcement mechanisms, and recent developments: 

🏛️ Key IP Laws and Regulations

1. Industrial Property Protection Law (No. 87-18/AN-RM of March 9, 1987)

Scope: Covers patents, utility models, industrial designs, trademarks, trade names, and competition 

Implementation: Subject to the Bangui Agreement, which established OAPI 

Patent Protection: Inventions must be novel, involve an inventive step, and be capable of industrial application The patent term is 20 years from the application date 

Employee Inventions: Ownership depends on the employment contract; inventions made during employment may belong to the employer 

Exploitation Rights: Unauthorized exploitation of a patented invention is prohibited, with provisions for compulsory licensing in the public interest

2. Copyright Law (No. 08-024 of July 23, 2008)

Scope: Protects literary, artistic, and scientific works, including expressions of folklore, performers, producers of phonograms, and broadcasting organizations 

Protection Criteria: Automatic upon creation; no registration required 

Duration: Life of the author plus 50 years

Malian Centre for the Promotion of Intellectual Property (CEMAPI)  Handles industrial property rights violation. 

Malian Customs Plays a role in preventing the importation of counterfeit good.
