Geographical Indications Law in Albania
Geographical Indications Law in Albania
Geographical Indications (GIs) in Albania are protected under the country’s intellectual property laws, in alignment with international agreements such as the TRIPS Agreement and the European Union regulations.
1. Legal Framework
Law No. 9313, dated 19 May 2005 — “On Geographical Indications and Designations of Origin”
This is the primary law regulating the protection of GIs in Albania.
It establishes the procedures for registration, protection, and enforcement of GIs and appellations of origin.
The law distinguishes between:
Geographical Indications (GIs): Names indicating a product originates from a specific geographical area where a given quality, reputation, or other characteristic is attributable to that area.
Appellations of Origin (AOs): A specific type of GI where the qualities and characteristics of the product are essentially or exclusively due to the geographical environment, including natural and human factors.
Intellectual Property Code (updated over time) also provides complementary provisions regarding trademarks and industrial property.
2. Administration and Registration
The General Directorate of Industrial Property (GDIP), under the Ministry of Economy, is responsible for:
Receiving GI applications.
Examining and granting GI registrations.
Maintaining the official register of GIs and appellations of origin.
Registration grants exclusive rights to the producers in the designated area, allowing only authorized users to use the registered GI or AO.
The registration process involves:
Submission of an application with product specifications.
Proof of link between product quality/reputation and geographical origin.
Examination for compliance.
Publication of the GI for possible oppositions.
3. Protection Scope
Protection covers agricultural products, foodstuffs, wines, spirits, and handicrafts.
Registered GIs and AOs are protected against:
Unauthorized use or imitation.
False or misleading indications.
Any act that could damage the reputation of the GI.
The protection lasts 10 years and can be renewed indefinitely.
4. International Context
Albania, as a candidate country for the European Union, harmonizes its GI laws with EU standards.
It is a member of:
World Trade Organization (WTO) — bound by TRIPS Agreement.
Paris Convention for the Protection of Industrial Property.
Has bilateral agreements and is moving toward aligning fully with EU intellectual property frameworks.
5. Examples of Albanian Geographical Indications
Kashkaval Cheese from Korça
Sharrë Olive Oil
Berat Pomegranates
Gjirokastër Rugs
These products benefit from GI protection that helps preserve traditional methods and local reputation.
Summary
Albania has a clear and structured system for the protection of geographical indications, rooted in Law No. 9313/2005, supported by the GDIP, and aligned with international and EU standards. This legal protection helps Albanian producers add value to their traditional products and protect them from unfair competition and misuse.
