Intellectual Property Laws at Montserrat (BOT)

Application Process: Requires submission of a complete specification within nine months from the application date. 

Term: Patents are granted for 14 years from the filing date. 

Annual Fees: Due starting from the fourth anniversary of the filing date; non-payment can result in rights being placed in abeyance. 

International Treaties: Montserrat is not a signatory to the Patent Cooperation Treaty (PCT), so PCT national phase filings are not possible. 

2. Trademarks

The Trade Marks Act (Cap. 15.23) regulates trademark registration. Notable aspects include: 

Unregistrable Marks: Marks that are descriptive, deceptive, or similar to existing registered marks may be refused registration.

Opposition: Third parties can oppose registration within a prescribed period after publication. 

3. Designs
