1. Definition and Scope
An industrial design in Liberia is defined as any composition of lines or colours, or any three-dimensional form, whether or not associated with lines or colours, that gives a special appearance to a product of industry or handicraft and can serve as a pattern for a product of industry or handicraft
2. Registrability Criteria
Novelty: The design must be new, meaning it has not been disclosed to the public anywhere in the world prior to the filing date or priority date of the application.
Exclusions: Designs that are dictated solely by technical or functional considerations are excluded from registration.
3. Application Process
Filing Requirements: The application must be filed with the Registrar and include a request, drawings, photographs, or other adequate graphic representations of the article embodying the industrial design, and an indication of the kind of products for which the industrial design is to be used.
Examination: The Registrar examines the application to ensure compliance with formal requirements and to determine whether the design falls within the definition of a design.
Publication: Upon registration, the fact of registration is published, and a registration certificate is issued.
4. Duration and Renewal
Initial Term: The initial term of protection is five years.
Renewal: The protection can be renewed for two further five-year terms, totaling a maximum of 15 years
5. Rights Conferred
The owner of a registered industrial design has the exclusive right to exploit the design, including the right to make, sell, or import an article bearing the design or something that is substantially a copy of the design, provided that such acts are done for commercial purposes.
6. International Protection
Liberia is a member of the African Regional Intellectual Property Organization (ARIPO) and adheres to the Harare Protocol, which allows for the protection of industrial designs in multiple member states through a single application.
7. Enforcement and Challenges
While the legal framework for industrial design protection exists, enforcement remains a challenge. The Liberia Intellectual Property Office (LIPO) faces limitations in technical and financial capacity to address intellectual property rights infringements.
