National IP Laws
1. Copyright Act (2023)
Overview The Copyright Act, signed into law on March 17, 2023, modernizes Nigeria's copyright regime. It introduces provisions for voluntary registration, anti-piracy measures, performer’s rights, and collective management of right.
Protection Scope Covers literary, musical, artistic, audiovisual works, sound recordings, and broadcast.
Duration Protection lasts for the life of the author plus 70 years.
Enforcement The Nigerian Copyright Commission (NCC) is empowered to block or disable access to infringing content and to enforce penalties for violation.
2. Trade Marks Act (Cap T13, LFN 2004)
Definition A trademark includes words, letters, labels, numerals, colours, shapes, or combinations thereof that distinguish goods or service.
Protection Valid for an initial period of seven years, renewable for subsequent periods of 14 year.
3. Patents and Designs Act (Cap P2, LFN 2004)
Patentability Inventions must be novel, involve an inventive step, and be capable of industrial application.
Duration Patents are protected for 20 years from the filing date, subject to the payment of annual fee.
Industrial Designs Protection is granted for five years, renewable up to a maximum of 25 year.
4. National Office for Technology Acquisition and Promotion (NOTAP) Act (1979)
