1. Patents and Utility Models

Governing Law: Decree-Law No. 290/2012 on Inventions and Industrial Design  

Patent Types: Inventions and utility model  

Protection Duration: 20 years for inventions; 15 years for utility model  

Application Process: Applications can be filed directly in Cuba or via the Patent Cooperation Treaty (PCT)  The Cuban Industrial Property Office (OCPI) administers the process, which includes a preliminary examination, publication, and formal examination The average time from filing to grant is approximately four years  

2. Trademarks

Governing Law: Decree-Law No. 203/1999 on Trademarks and Other Distinctive Sign  

Protection Duration: 10 years, renewable indefinitely  

Application Process: Cuba follows a "first-to-file" system Applications must be filed with OCPI and are examined for distinctiveness and legality  An opposition period of 60 days follows publication in the Official Industrial Property Gazette  Cuba adheres to the 11th edition of the Nice Classification  

3. Copyright

Governing Law: Law No. 14/1977 on Copyright  

Protection: Automatic upon creation  

Duration: Life of the author plus 50 years

4. Industrial Designs
