Geographical Indications Law in Comoros

The Union of the Comoros is actively working towards establishing a legal framework for the protection of Geographical Indications (GIs), with a particular focus on the renowned “Ylang-Ylang des Comores.”

🇰🇲 Current Status of GI Protection in the Comoros

1. National Legal Framework

As of now, the Comoros does not have a dedicated national law for the protection of GIs. However, the country is a member of the Organisation Africaine de la Propriété Intellectuelle (OAPI), which provides a regional system for the registration and protection of GIs among its member states. This system allows the Comoros to utilize OAPI's framework for GI protection, even in the absence of national legislation.

2. Ongoing Initiatives and Support

In September 2023, the African Intellectual Property Organization (OAPI), in collaboration with the African Regional Intellectual Property Organization (ARIPO) and the European Union Delegation in Comoros, organized a workshop in Moroni to support the registration of the "Ylang-Ylang des Comores" GI. This workshop aimed to guide stakeholders in drafting specifications for the GI and to present a prospective study to support future GI applications. Key issues discussed included the choice of name, the group responsible for defending the GI, and the institutional and technical support needed for registration and operation. The excellence of Comorian Ylang-Ylang oil has made it internationally recognized, and protecting this GI is vital for the local economy.
