Trade Marks Ordinance 1981

The Trade Marks Ordinance 1981 governs the registration and protection of trademarks in the TCI, The Financial Services Commission (FSC) serves as the Registrar of Trademarks, overseeing all registrations, Trademarks are registered for 10 years from the date of registration or the last renewal and can be renewed for subsequent 10-year periods

Registration Process The application is published in the Government Gazette, allowing for a one-month opposition perio. If uncontested, the trademark is registere.

Patents

Registration Patents must be registered in the United Kingdo. The TCI grants an extension of UK patent rights upon submission of a UK registration certificate.

Duration The TCI patent expires on the same date as the UK patent, typically 20 years from the filing date.

Copyright

Protection Automatic upon creation for original works, including literary, dramatic, musical, and artistic work. Protection lasts for 50 years after the author's death.

Enforcement Rights holders can seek remedies such as damages or injunctions for infringement.

Industrial Designs

Status The TCI does not have specific legislation for the protection of industrial design.

💰 Fees and Formalities

*Trademark Registration Fee: $200 per clas.

*Patent Registration Fee: $100 (for UK-registered patent).

*Annual Maintenance Fee: $100, payable each January to maintain trademark registration in good standig.

*Renewal: Trademarks can be renewed for additional 10-year periods. A grace period of one month is allowed after the expiration date for renewal upon payment of a late fee.
