Intellectual Property Laws at Sweden

Sweden has a well-established and comprehensive intellectual property (IP) framework, managed by the Swedish Intellectual Property Office (PRV). This framework encompasses patents, trademarks, designs, copyrights, trade secrets, and related rights, aligning with both national and international standards.

1. Patents

Protection:  Grants exclusive rights to new, inventive, and industrially applicable technical solutions for up to 20 years 

Administration: Handled by PRV, which examines applications and issues patents 

International Framework:  Sweden is a member of the Patent Cooperation Treaty (PCT), allowing for international patent filings   

2. Trademarks

Protection:  Covers distinctive signs such as words, logos, colours, or sounds that distinguish goods or services 

Duration:  Initial protection lasts 10 years and can be renewed indefinitely 

Administration: Managed by PRV, which ensures that trademarks are unique and not conflicting with existing ones   

3. Designs

Protection:  Safeguards the appearance of a product, including its shape, colour, and texture 

Duration:  Protection can last up to 25 years, with renewals every five years 

Administration: Handled by PRV, which examines and registers design applications   

4. Copyright

Protection:  Automatic upon creation for original works of authorship, including literature, music, and art 

Duration:  Lasts for the lifetime of the author plus 70 years 

Administration: While registration is not required, PRV provides resources and guidance on copyright matters   

5. Trade Secrets

Protection:  Covers confidential business information that provides a competitive edge 

Legislation:  The Act on the Protection of Trade Secrets (1990:409) outlines the legal framework for safeguarding trade secrets

🌐 International Treaties

  Sweden is a signatory to several international IP agreements, including:   

Berne Convention   For the protection of literary and artistic work. 

Paris Convention   For the protection of industrial property. 

Patent Cooperation Treaty (PCT)   Facilitates international patent filing. 

Madrid Protocol   Allows for the international registration of trademark. 

Hague Agreement   Provides a mechanism for international design registrations.

  PRV is the central authority responsible for the administration and enforcement of IP rights in Sweden     It handles registrations, examinations, and provides guidance on IP mattes   For enforcement, IP holders can seek remedies through Swedish course.
