Intellectual Property Laws at Algeria

Algeria's intellectual property (IP) framework is structured to protect the creations of the mind, encompassing various forms such as patents, trademarks, industrial designs, and copyrights. The Algerian National Institute of Industrial Property (INAPI) is the central authority overseeing the registration and enforcement of industrial property rights.

Key Aspects of Algeria's Intellectual Property Laws

1. Patents

Protection Duration: Patents are granted for inventions that are novel, involve an inventive step, and are industrially applicable. The protection lasts for 20 years from the filing date, subject to the payment of annual maintenance fees 

Filing Requirements: Applicants must submit a request, detailed description, claims, drawings (if necessary), and an abstract. Foreign applicants are required to appoint a local representative 

2. Trademarks

Protection Duration: Trademark rights are obtained through registration with INAPI for a period of ten years, renewable indefinitely for consecutive ten-year periods 

Filing Requirements: The application must include the applicant's full name and address, a reproduction of the mark, a list of goods and services, and proof of payment of filing and publication fees. Foreign applicants must be represented by an authorized representative 

3. Industrial Designs

Protection Duration: The protection for industrial designs lasts for ten years from the filing date, divided into two parts: the first year remains secret if the applicant does not request publication, and the second part is nine years, during which protection is obligatorily published 

Filing Requirements: Applicants must submit an application form, power of attorney (if applicable), six copies of the design photography, and the receipt of payment for the corresponding filing tax 

4. Copyrights

Protection Duration: Copyright protection is automatic upon the creation of a work and does not require registration. The protection lasts for the lifetime of the author plus 50 years 

Covered Works: Literary and artistic works such as essays, short stories, poems, paintings, drawings, charts, and photographs are eligible for copyright protection 

Enforcement and Dispute Resolution

Algeria has taken steps to improve the enforcement of IP rights, including disbanding informal markets selling counterfeit goods and increasing coordination between customs authorities and law enforcement. Specialized IP tribunals have been established to handle IP disputes, providing a forum tailored to the nuances of IP law

Algeria is a signatory to several international agreements that facilitate the protection of intellectual property, including:

Paris Convention for the Protection of Industrial Property

Berne Convention for the Protection of Literary and Artistic Works

Patent Cooperation Treaty (PCT)

Madrid Protocol for the International Registration of Marks

These agreements enable Algerian creators and businesses to seek protection for their intellectual property in multiple jurisdictions
