Macau, a Special Administrative Region of China, has a well-structured legal framework for the protection and enforcement of intellectual property (IP) rights. Here's an overview of the key aspects of IP law in Macau: 

🏛️ Legal Framework

 Macau's IP system is governed by several key laws and regulations 

Industrial Property Legal Code: Established by Decree-Law No. 97/99/M, this code regulates patents, trademarks, designs, and other industrial property rights 

Copyright Code: Decree-Law No. 43/99/M governs the protection of literary and artistic works, including computer programs 

Decree-Law No. 16/95: This law addresses the termination of patents, including provisions on invalidity and lapse 

📄 Types of IP Protection

1. Patents

Eligibility Inventions that are new, involve an inventive step, and are industrially applicable. 

Application Process Applicants must submit specifications, claims, title, written description, drawings, and an abstract in Chines.  The application is published in the Macau Official Gazette 18 months after filing.  Oppositions can be filed during the publication period.

Duration 20 years from the filing dat.

2. Trademarks

Eligibility Signs capable of distinguishing goods or services of one enterprise from those of another. 

Application Process Applications are filed with the Economic and Technological Development Bureau (DSEDT.  The registration confers exclusive rights to the trademark owner.

Duration 10 years from the registration date, renewable indefinitely. 

3. Designs

Eligibility Aesthetic aspects of a product that are new and original. 

Application Process Applications are filed with the DSED.  The registration confers exclusive rights to the design owner.

Duration 5 years from the registration date, extendable up to 25 years. 

4. Copyrights

Eligibility Original works of authorship, including literary, artistic, and musical work. 

Registration Not mandatory, but recommended for legal certainty. 

Duration Life of the author plus 50 years.

*Criminal Actions:  Penalties, including fines and imprisonment, for serious infringements. 

*Customs Enforcement:  The Customs Department can seize counterfeit goods at the border.
