Intellectual Property Laws at Palestine

Palestine has a developing intellectual property (IP) legal framework that aims to protect creators' rights across various domains, including copyrights, trademarks, patents, and industrial designs. While the system is evolving, several institutions and legal entities are actively working to enhance IP protection in the region. 

🏛️ Key IP Legislation

1. Copyright Law Palestine is not a member of the Berne Convention, which means that copyright protection may not be automatically extended internationally However, copyright protection is available domestically for original works, including literary, artistic, and musical creations Registration is recommended to facilitate enforcement and establish a public record of ownership

2. Trademark Law The Palestinian Ministry of National Economy oversees trademark registration The process follows a "first to file" principle, granting rights to the first party to register a mark Trademark protection lasts for seven years from the registration date and can be renewed for additional periods Opposition to a trademark application can be filed within three months of its publication in the Official Gazette

3. Patent Law Patents are governed by the Patent Law in Palestine, which provides protection for inventions that are novel, involve an inventive step, and are industrially applicable Patent protection is granted for 20 years from the filing date Palestine is a member of the Patent Cooperation Treaty (PCT), allowing for international patent filings

4. Industrial Design Protection for industrial designs is available for the aesthetic aspects of products Designs must be novel and original to qualify for protection The duration of protection varies and is subject to renewal

🛡️ Enforcement and Administration

The General Directorate of Intellectual Property (GDIP), under the Ministry of National Economy, is the primary authority responsible for IP administration in Palestine. The GDIP oversees the registration of trademarks, patents, and designs, and works to enhance IP awareness and enforcement. Additionally, several law firms specialize in IP matters and offer services ranging from registration to litigation:  

🌐 International Cooperation

In March 2024, a Cooperation Protocol was signed between Türkiye and Palestine for collaboration on industrial property rights This agreement aims to enhance Palestine's capacity in intellectual property and innovation.
