Intellectual Property Laws at Brunei

Brunei Darussalam has established a robust intellectual property (IP) framework that aligns with international standards, offering comprehensive protection for trademarks, patents, industrial designs, and copyrights.

🏛️ Key IP Legislation

 Brunei's IP laws are administered by the Brunei Intellectual Property Office (BruIPO) and include

Patents Order 2011: Governs the protection of inventions in Brunei

Trade Marks Act: Regulates the registration and protection of trademarks

Industrial Designs Act: Provides protection for the visual design of objects

Copyright Order 2011: Protects literary, artistic, and musical works

Merchandise Marks Act: Addresses the use of marks on goods to prevent deception  These laws are complemented by various regulations and rules, such as the Patents Rules 2012 and the Trade Marks Rules 2018 

🌐 International Treaties

 Brunei is a member of several key international IP treaties:

Madrid Protocol (2017)  Allows for the international registration of trademarks in over 100 countries through a single application 

Patent Cooperation Treaty (PCT) (2012) Facilitates the filing of international patent applications in multiple countries 

Hague Agreement (2013) Enables the international registration of industrial designs in multiple jurisdictions 

Berne Convention Ensures automatic copyright protection in member countries.

WIPO Copyright Treaty (WCT) and WIPO Performances and Phonograms Treaty (WPPT)  Provide additional protections for digital and performance-related work.

🛡️ Enforcement and Protection

*Patent Protection:  Inventions are protected for 20 years, subject to annual renewal fees.

*Trademark Protection:  Trademarks are registered for 10 years, with the possibility of renewal.

*Industrial Design Protection:  Designs are protected for up to 15 years.

*Copyright Protection:  Lasts for the lifetime of the author plus 50 years.

 Brunei enforces IP rights through its legal system, including the Penal Code and Customs Order, which address infringements and unauthorized use
