Intellectual Property Laws at Seychelles

Seychelles has established a comprehensive legal framework for intellectual property (IP) protection, aligning with international standards and treaties. Here's an overview of the key IP laws and regulations in Seychelles: 

📜 Key IP Legislation

1. **Industrial Property Act, 2014 (Act No. 7 of 2014)** This Act, effective from March 1, 2015, governs patents, utility models, industrial designs, trademarks, geographical indications, trade names, layout designs of integrated circuits, and undisclosed information (trade secrets)  It replaced the outdated Patent Act of 1901 and the Trade Marks Decree of 1977  The Act incorporates provisions for provisional judicial measures, civil remedies, and criminal penalties for IP infringements, including fines up to SR500,000 and/or imprisonment for up to five years

2. **Copyright Act, 2014 (Act No. 5 of 2014)** Effective from August 1, 2014, this Act protects literary, musical, artistic, performance, film, and sound works  Notably, it includes provisions for the protection of traditional cultural expressions (folklore), encompassing verbal, musical, performative, and tangible forms of cultural heritage  The standard term of protection is the lifetime of the author plus 50 years  However, Seychelles is not yet a member of the Berne Convention for the Protection of Literary and Artistic Works

🌍 International Treaties and Regional Cooperation

 Seychelles is a member of the African Regional Intellectual Property Organization (ARIPO), having joined on January 1, 202.  ARIPO administers regional IP treaties covering patents, trademarks, industrial designs, and traditional knowledge.  Additionally, Seychelles is a signatory to the Patent Cooperation Treaty (PCT) and the Paris Convention, facilitating international patent and trademark protection.

🛡️ Enforcement and Remedie

 IP enforcement in Seychelles includes: 

*Civil Actions:  Injunctions, damages, and orders for the cessation of infringing activities. 

*Criminal Sanctions:  Fines up to SR500,000 and/or imprisonment for up to five years for serious infringements. 

*Administrative Measures:  Customs regulations to prevent the importation of counterfeit goods. 

 The Registrar of Patents oversees the registration of patents, while the Registrar of Trademarks manages trademark registrations   The Supreme Court of Seychelles handles IP disputes and enforcement actions.

📈 National IP Strategy

 Seychelles is in the process of developing a national IP strategy to enhance the protection and utilization of intellectual property in the country.   This initiative aims to support economic development by fostering innovation and creativity.   The strategy is being developed in collaboration with the Department of Trade and the African Regional Intellectual Property Organization (ARIO.   The strategy will guide IP policy, law reviews, capacity building, and international cooperation.
