Title: Service of documents

This section lays down how documents, notices, and communications may be served to or by a company under the Act.

(1) A document may be served on a company or an officer thereof:

By sending it to the registered office of the company:

by post, or

by registered post, or

by speed post, or

by courier service, or

by leaving it at its registered office, or

by means of electronic mode (as may be prescribed), or

by any other mode as prescribed.

(2) A document may be served by the company on a member:

By:

post,

registered post,

speed post,

courier,

delivery at the member’s address,

electronic mode, or

any other mode as prescribed.

Note: A member can request the document in a particular mode (e.g., physical copy), but if that mode involves extra cost (like courier), the member has to pay in advance the fee as prescribed by the company.

(3) For the purposes of this section, “document” includes:

Summons, notice, requisition, order, declaration, form, and any other official communication.
