Title: "Effect of neglect of promisee to afford promisor reasonable facilities for performance"

Bare Text of Section 67:

“If any promisee neglects or refuses to afford the promisor reasonable facilities for the performance of his promise, the promisor is excused by such neglect or refusal as to any non-performance caused thereby.”

Meaning:

If the promisee (the one to whom the promise is made) fails to give the promisor (the one making the promise) the reasonable opportunity or facilities needed to fulfill the promise, then the promisor is not liable for failing to perform his part of the contract.

📌 Illustration (from the Act):

A contracts with B to repair B’s house, and B must give A access to the house.

B refuses to let A enter the house.

A is excused from performing the contract due to B’s refusal to cooperate.

🔍 Key Points:

Promisee's cooperation is essential for some contracts.

Neglect or refusal to provide such cooperation makes the promisee responsible for non-performance.

This section provides relief to the promisor when the failure was caused by the promisee's conduct.
